What Is an FSSAI License and Who Is Required to Hold One?
An FSSAI license is a mandatory authorisation issued under the Food Safety and Standards Act, 2006 by the Food Safety and Standards Authority of India.
Under Section 31 of the FSS Act, every food business in India — whether you manufacture food, run a restaurant chain, import or export food products, operate a packaged food brand, distribute food commercially, or carry out any other food-related activity — is legally required to hold this license or registration before commencing operations. There are no exemptions based on business type.
The FSS Act classifies food businesses into three licensing tiers based on annual turnover, revised with effect from 1 April 2026. Businesses with turnover up to ₹1.5 crore fall under Basic Registration. Those with turnover between ₹1.5 crore and ₹50 crore require a State License. Any food business above ₹50 crore — or any business involved in imports, exports, or multi-state operations — must hold a Central License.
All three categories are processed through the FoSCoS portal. A correctly submitted application demands accurate category selection, complete documentation, and precise alignment between the license type and your actual business scale. An incorrect category selection triggers a full re-application, resetting the processing clock by four to six weeks.
Is FSSAI License Mandatory for Food Manufacturers, Exporters, and All Other Food Businesses?
Every food business operating in India must hold a valid FSSAI license or registration — there is no legal exemption based on size or type of business alone. The applicable license category is determined by annual turnover, the nature of operations, and how widely the business operates geographically.
Importers and exporters of food products are mandated to hold a Central License irrespective of turnover. This also means that export registrations such as APEDA RCMC are only processed once the Central FSSAI License is in place. Businesses that begin export registrations before securing their Central License routinely discover this dependency too late, adding months to their export readiness timeline.
Businesses operating across multiple states require a Central License regardless of whether each individual unit crosses the ₹50 crore threshold on its own. Units supplying to central government establishments, railways, or airports are also mandated to hold a Central License.
Every food business holding a Central License is additionally required to ensure each product they sell carries FSSAI labelling compliant packaging — label non-compliance can trigger product recalls and regulatory notices even when the underlying license is fully valid.
